DECLARATION OF NON-OWNER OCCUPANCY & BUSINESS USE OF PROCEEDS
I (Borrower) hereby affirm and represent to the lender (“Originator”) the following:
I declare that I do not presently occupy, nor do I intend to occupy, the property(ies) identified in my loan application as my primary residence or as a secondary/vacation home. I further affirm that no surviving spouse, relative, or family member will reside in said property(ies). I acknowledge that this is a business-purpose loan, not a personal or household-purpose loan. The loan proceeds will be applied exclusively for business or investment purposes, and not for personal, family, or household use. I confirm my understanding of the distinction between consumer loans intended for personal purposes and commercial loans intended for business purposes.
I acknowledge and agree that this loan is a commercial transaction and, as such, is not governed by any federal or state consumer credit protection laws, including but not limited to the Truth in Lending Act (TILA) (15 U.S.C. §1601 et seq.), the Real Estate Settlement Procedures Act (12 U.S.C. §2601 et seq.), or the Homeowners Protection Act (12 U.S.C. §4901 et seq.).
AUTHORIZATION TO CONDUCT CREDIT & BACKGROUND CHECK
By checking below: (i) I expressly authorize Park Place Finance, LLC and its authorized agents to make any inquiries and obtain any information deemed necessary or reasonable regarding the details provided in this application or any related documentation; (ii) I grant permission to Park Place Finance, LLC to procure a consumer credit report concerning me; (iii) I authorize Park Place Finance, LLC to obtain or conduct a background investigation; and (iv) I authorize Park Place Finance, LLC to perform an Pre-Qualification (soft credit inquiry) within 365 days of the initial credit report (hard inquiry), if required, to confirm the ongoing validity of lending considerations.
I understand that the lender, its assigns, and successors will rely on the accuracy of the information provided in this application. I confirm that I have reviewed and understood the contents of this declaration. I am aware that knowingly providing false or misleading information in connection with this mortgage application constitutes a federal offense, punishable by fines and/or imprisonment under Title 18, United States Code, §1014. By submitting this application, I affirm that all statements made herein are true, correct, and complete to the best of my knowledge.
